Our collective experience in asbestos legal services has been used in several hundred reports utilising the expertise of senior consultants with many years of experience in the fields of occupational hygiene, asbestos fibre concentration measurement, retrospective risk assessment and the development of hygiene standards.
Expert advice is sought often in relation to retrospective occupational histories where one or more Claimants have developed respiratory diseases and exposure to asbestos is alleged. In these cases an understanding of the nature of the Claimant’s working practices is necessary to develop exposure models which provide the Court with an understanding of the magnitude of those exposures. The exposure models help to develop an understanding of the risk of adverse health effects in the context of the occupational exposure limits at the time of the exposures.
Experts in the field require to understand the history of the development of knowledge and of the evolution of occupational exposure limits from 1960, when exposure limits were first introduced into the UK , up to the present day.
The exposure dose models assist the Court in assessing the level of apportionment for multiple Defendants where the exposures of Claimants may be spread across several different employments.
Several of our experts regularly provide advice to professional bodies on the activities of organisations undertaking work within the asbestos removal industry and the standard of compliance of asbestos removal contractors and analytical consultants with Approved Codes of Practice and Guidance issued by the Health and Safety Executive
IOM consultants have also been asked to offer opinion to enforcing authorities on the compliance of companies trading within the enforcement area in relation to their statutory duties under the Control of Asbestos Regulations (as amended) and in particular the Duty to Manage Asbestos in Non-Domestic Premises.
